1. ACCEPTANCE OF TERMS

By accessing or using Unhinged AI ("Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

You must be at least 18 years old to use this Service.

2. SERVICE DESCRIPTION

Unhinged AI is an automated assistant that:

• Connects to your Tinder account via browser automation
• Swipes on profiles on your behalf
• May message matches based on your preferences (future feature)
• Sends you notifications about matches and activity

3. CRITICAL WARNINGS AND DISCLAIMERS

3.2 NO WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION.

3.3 NO GUARANTEED RESULTS

We make NO guarantees regarding:

• Number of matches, likes, or dates
• Quality of matches
• Success in dating
• Your Tinder account remaining active
• Continuous service availability

4. LIMITATION OF LIABILITY

4.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW:

WE ARE NOT LIABLE FOR:

• Your Tinder account being suspended, banned, or terminated
• Loss of matches, messages, or data on Tinder
• Any direct, indirect, incidental, special, consequential, or punitive damages
• Lost profits, revenue, or opportunities
• Emotional distress or disappointment
• Actions of third parties (including Tinder)
• Technical failures or service interruptions

OUR TOTAL LIABILITY SHALL NOT EXCEED the amount you paid to us in the 12 months preceding the claim, or $100 USD, whichever is less.

4.2 INDEMNIFICATION

You agree to indemnify and hold harmless Unhinged AI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or violation of Tinder's Terms of Service.

5. YOUR RESPONSIBILITIES

5.1 You Agree To:

• Provide accurate information (email, phone number, location)
• Keep your Tinder account credentials secure
• Not share access to your Unhinged AI account
• Comply with all applicable laws
• Not use the Service for any illegal purposes
• Not attempt to reverse engineer, hack, or abuse the Service

5.2 You Acknowledge That:

• You are responsible for all activity on your connected Tinder account
• Messages sent to matches may be automated or AI-generated
• Your preferences guide but do not guarantee specific behaviors
• Session data and recordings may be stored for debugging

6. PAYMENT TERMS

6.1 Subscription

• Subscription is billed monthly at the current rate ($29.99/month)
• Payment is processed securely by Stripe
• Subscription auto-renews unless cancelled

6.2 Cancellation

• Cancel anytime via the "Manage subscription" command
• Service continues until end of current billing period
• No partial refunds for unused time

6.3 Refund Policy

Standard Policy: No refunds for service rendered.

Exception: If your Tinder account is banned within 7 days of your initial subscription and before any swiping occurs, you may request a full refund.

No refunds for: Bans after swiping has occurred, bans after 7 days, dissatisfaction with results, technical issues that are resolved, or change of mind.

7. INTELLECTUAL PROPERTY

All content, features, and functionality of the Service are owned by Unhinged AI and protected by intellectual property laws. You may not copy, modify, distribute, reverse engineer, or decompile our systems, or use our trademarks without permission.

8. TERMINATION

8.1 By You

You may stop using the Service at any time by cancelling your subscription or requesting account deletion.

8.2 By Us

We may suspend or terminate your access if you violate these Terms, engage in fraudulent activity, abuse the Service, or fail to pay subscription fees.

8.3 Effect of Termination

Upon termination, your access stops immediately. We may delete your data (except as required for legal compliance). You remain liable for any outstanding payments.

9. DISPUTE RESOLUTION

9.1 Informal Resolution

Before filing any claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days.

9.2 Arbitration

Any disputes not resolved informally shall be resolved by binding arbitration under the rules of the American Arbitration Association.

9.3 Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES ONLY ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS OR CLASS ARBITRATIONS.

10. CHANGES TO TERMS

We may modify these Terms at any time. We will notify you of material changes via the bot. Continued use after changes constitutes acceptance of the new Terms.
